Errors & Omissions FAQ

While professional liability insurance (E&O) isn't explicitly required by the state, it is highly recommended and may even be required by insurance carriers that an agency represents. Carrying such a policy can help protect your business against any potential client lawsuits or other financial risks.

OIA strives to provide resources and support for managing risk in professional liability insurance. The following are several best practices to implement in mitigating E&O risks:

  • Education and training: Agents and underwriters should invest in ongoing professional development to stay current with industry trends and regulations.
  • Documentation best practices: Detailed records of client interactions, underwriting decisions, and policy terms can help mitigate disputes and support claims defense.
  • Timing: Contact wholesalers far in advance of the desired effective date to determine what is needed for renewals and if there have been any changes in the coverages or terms.
  • Review policy coverage: Be sure to thoroughly review the proposal and policy to ensure the coverage that was requested was provided. If it wasn’t, be sure to find out if it can be obtained.
